Electronic Signatures: The Legal Landscape
Electronic signatures are legally recognized in most major jurisdictions:United States (ESIGN Act, 2000): Electronic signatures have the same legal effect as handwritten signatures on contracts affecting commerce. Intent to sign is the key requirement — not the specific technology.
European Union (eIDAS Regulation, 2016): Defines three tiers: Simple Electronic Signature, Advanced Electronic Signature, and Qualified Electronic Signature. For most contracts, Simple EAS suffices.
India (IT Act 2000): Recognizes electronic signatures. Digital signatures using DSC (Digital Signature Certificate) are the legally preferred form for certain government submissions.

When Not to Use This Approach
Government submissions requiring DSC: In India, income tax filings, MCA company filings, and customs documents require a Digital Signature Certificate — a cryptographic signature, not an image. An image signature overlay will not be accepted here.Bank or financial institution forms: Most banks require either a physical wet signature or a specific digital signature mechanism they control.
For everything else — employment contracts, NDAs, freelance agreements, rental agreements, consent forms — a properly placed signature PNG is generally legally sufficient.
